State of Emergency Procurement

COVID Controller

Emergency

The Emergency (General Provisions) (COVID-19) Act 2020 Section 8 and Emergency (General Provisions) (COVID-19) Regulation 2020 Section 9 are Sections related to Procurement during the State of Emergency.

The sections specify –

  1. The National Procurement Act 2018 and the Public Finance (Management) Act 1995 must not apply to all procurement for the purpose of the national emergency.
  2. The procurement of goods, works and services for the purposes of the national emergency must be done in consultation with the Emergency Controller.
  3. The Emergency Controller must submit to the National Executive Council, no later than three months after the end of the national emergency, a report on all procurement undertaken during the national emergency.

Further information will be provided shortly on how to manage procurement during the State of Emergency. The Emergency Controller is required to report to National Executive Council and will therefore require records of procurement, methods of procurement and how reasonableness of costs were identified (if not competitive) for State of Emergency procurement.
